Written by Ella Rawls, Legal Director Arizona Justice For Our Neighbors strongly condemns the actions of Border Patrol in their unnecessarily violent and menacing behavior toward our Haitian migrant brothers and sisters in Del Rio, Texas. Scenes this weekend showing physical abuse and intimidation from white or white passing Border Patrol agents, against black migrants are blatantly reminiscent of the racial power imbalance pervading the United States since inception.[1] In the nearly 100 years that Border Patrol has been in existence, their racist beginnings are still showing. At the beginning of Border Patrol ¼ of their agents were affiliated with the Ku Klux Klan.[2] It appears almost 100 years of violence and brutality have not changed.
The reason that thousands of migrants are living and congregating under a bridge in Del Rio, Texas is because of the border being closed to asylum seekers. The Biden administration has chosen to continue to use the Center for Disease Control’s Title 42 public safety measure, that is pretextual in its purported purpose of preventing COVID-19, to deny entry to asylum seekers at the southern border.[3] Public health experts have stated repeatedly that the spread of COVID-19 is not justified by this policy – rather the policy is politically motivated.[4] It is our duty to welcome our Haitian brothers and sisters who are fleeing their home country due to upheaval because of the recent assassination of Jovenel Moise, their late president, as well as fleeing the destruction and devastation that the recent earthquake created. By engaging in violence against black migrants at our southern border, we are perpetuating the generational racially motivated imbalance of power and contributing to the trauma and racial animus these thousands of migrants have already endured throughout their journeys to our border.[5] We demand the Biden Administration cease to use Title 42 to expel or deny migrants access to the asylum process. The abhorrent treatment of black migrants at the southern border by Border Patrol under this Administration, is a failure of humanity and inappropriate.
